State Supreme Court Judge Thomas D. Raffaele filed a complaint against an officer who allegedly struck him after he complained about the force being used to restrain a man in 2012.
Thomas Raffaele, 70, says he was the victim of excessive force when he complained about the force cops were using to restrain a man with a pipe in Jackson Heights in 2012.
His lawyer Barak Cardenas said in Brooklyn Federal Court that the video confirms Raffaele’s version of events.

“The video shows the judge is struck in the throat for no reason whatsoever,” Cardenas said.
Cardenas declined to make the video available to The Daily News.

The video, Cardenas said, was taken by a witness with a cellphone and was provided to the lawyer after Queens District Attorney Richard Brown concluded an investigation found no criminal wrongdoing by the officers at the scene.
City lawyer Virginia Nimick said in court that the Civilian Complaint Review Board’s investigation is ongoing.
