NY voters favor Vegas-style casinos


New York state voters are ready to roll the dice on allowing up to seven Las Vegas-style casinos, according to a poll released Monday.


When given the specific wording of the casino amendment appearing on the Nov. 5 Election Day ballot, 55 percent of those questioned by the Siena College Poll were in support and 42 percent weren’t.


The amendment says casinos would permit local governments to lower property taxes “through revenue generated.”


In the abstract, voters were divided equally 46-46 percent over whether casino gambling is such a hot idea.


Pollster Steve Greenberg said voters were apparently won over by the “jobs and new revenues” argument.

Attack On Brooklyn Man Being Investigated As Hate Crime


An attack in Brooklyn is being investigated as a hate crime, but the victim says he’s not gay.


David Jimenez, 40, was on South Third Street and Bedford Avenue walking his dogs last Wednesday night.


He says he ignored a group of people screaming gay slurs at him, but he says the group attacked him anyway.


He suffered a broken nose and a fractured eye socket.


Police caught one suspect and charge him with assault and possession of a controlled substance, but the Brooklyn District Attorney’s office says the defendant wasn’t charged because of discrepancies regarding his identity.


“My head, it cannot comprehend how this is the case, where you literally catch someone with blood in their hands, because when he was taken in, his fist was full of blood, and he’s out here walking while I’m in here locked in my house because I’m afraid of going outside,” Jimenez said.


Jimenez is now resting at home.


He’s expected to undergo surgery on Wednesday.

Shutdown showdown: No negotiations as lawmakers remain divided

Congress remained gridlocked Monday over legislation to continue funding the federal government. If both chambers fail to pass a resolution before midnight, the federal government will shut down.




With no negotiations or compromise in sight, the countdown to the first shutdown of the federal government in 17 years has begun.


The Senate, poised to convene at 2:00 p.m., is expected to reject a House bill, passed early Sunday morning by the lower chamber, that would delay “Obamacare” for a year as a condition for keeping the government running.


The Senate will almost certainly strip language from the bill about the delay and send a “clean” bill back to House that does just one thing – fund the government in the new fiscal year that begins Tuesday.


House Republicans would then have to decide, with the midnight deadline quickly approaching, whether to vote on it.

But as recently as Monday morning, GOP congressional leaders said the “clean” bill would be a non-starter and maintained their push to link the bill with delaying the President’s signature healthcare law.


“The fact that nobody knows what the rules are, employers are scared to death to hire new employees, cutting the hours many of their current employees, and for what reason?” House Majority Leader John Boehner said Monday. “This law is not ready for prime time.”


But Democrats are hoping the GOP’s bravado fades as the day goes on.


“Do we have to sacrifice the economy and help for millions of middle-class people?” New York Democratic Sen. Chuck Schumer said Monday on MSNBC’s “Morning Joe.”

“It’s real people with real lives at stake, and just to sacrifice them to the right-wing gods, for the sake of a day or two of showing, ‘oh yes, we’re serious,’ is a very cynical operation,” he added.


Even some Republicans began criticizing their party’s leadership as a shutdown became more likely.


“I disagree with the strategy of linking Obamacare with the continuing functioning of government — a strategy that cannot possibly work,” Maine Republican Sen. Susan Collins said Monday.


Americans, for the most part, appeared to agree.

A CNN poll released Monday morning showed that 46% of U.S. residents would blame Republicans for a federal government shutdown, whereas only 36% would blame President Obama.


Another 13% said they would blame both Republicans and Obama, the poll showed.


If lawmakers do fail to achieve a resolution by midnight, large sections of the government would close, hundreds of thousands of workers would be furloughed without pay, and millions more would be asked to work for no pay — creating new risks for the fragile economy.


U.S. markets appeared to react accordingly Monday, as the Dow Jones Industrial Average plummeted more than 150 points in the first minutes of trading.


In recent trading, the benchmark index was down 110 points, or 0.7%.

Wall Street bigs back 2nd de Blasio fundraiser


Wall Street heavyweights are emptying their pockets for Democrat mayorial candidate Bill de Blasio.


In the second event in a week, a breakfast for de Blasio on Wednesday at The Yale Club has drawn support from such top Wall Street moneymen as Evercore Chairman Roger Altman, the former deputy treasury secretary under Bill Clinton.


Orin Kramer, a top democratic fundraiser for President Obama during both his presidential campaigns who runs hedge fund Boston Provident, is another chair of the event.


Others chairs — those promising to raise at least $ 10,000 — include Blair Effron, the former UBS vice chairman whose new firm is Centerview Partners, and Michael Schlein of Accion International, a micro finance lender.


Famed short-seller James Chanos, one of a handful of big-name hedgers, is a co-chair of the event.

The city hopes to reduce congestion on a busy stretch of Flatbush Ave. by eliminating one lane of traffic in each direction.


The sweeping proposal along the 2.3 miles between Empire Blvd. and Nostrand Ave. would replace the travel lanes with a center portion for left turns and designated commercial loading zones to curb double-parking.


“It’s a really straightforward way of making Flatbush Ave. safer and less congested,” said Caroline Samponaro of Transportation Alternatives, which promotes biking over fume-spewing cars.


The stretch in question is one of the city’s roughly dozen “Congested Corridors” being studied by the Department of Transportation.


It runs through the middle of Brooklyn and serves as a connector to the Belt Parkway, downtown Brooklyn and the Manhattan Bridge.


Traffic is particularly heavy near Brooklyn College, and at the major Nostrand Ave. intersection, known as the Junction, home to a new Target store.


Some residents are unconvinced that the proposed changes will help keep cars moving.


“It’s nonsensical,” argued community activist Zenobia McNally. “The problem is the double parking and that’s because they’ve removed all the parking here.”


But Samponaro said new, brighter pavement paint would “create a lot more structure and order.”


The turning lane in the middle of the road will help prevent accidents caused by drivers speeding past vehicles waiting to turn off the avenue, she added.


Flatbush Ave. isn’t the only city spot set to get a makeover.


In Park Slope, the city banned some left turns on jam-packed Fourth Ave., a traffic-calming measure that also eliminated a lane of car traffic in both directions.

City Planning Approves East Midtown Rezoning


A rezoning plan that would dramatically transform East Midtown Manhattan took another big step forward Monday even though significant opposition to the plan still persists. NY1′s Jon Weinstein filed the following report.


The plan would create millions of square feet of new office space in selected sites within a 73 square block section of Midtown East: Roughly from 39th to 57th streets and Fifth to Third avenues. On Monday, the City Planning Commission gave its overwhelming approval.


“If we are to continue to have a world class district with top tier, state-of-the-art office space we need to change the zoning, but carefully,” said New York City Department of Planning Director Amanda Burden.


A number of Manhattan Community Boards and elected officials still worry the plan for bigger office towers around Grand Central Terminal will bring an influx of people that will overwhelm the area. Many think the Bloomberg administration is moving too fast and that Monday’s 11-0 vote was a mistake.


“Two of the commissioners in their statements recognized the inadequacy of the plan as it is today, and yet one abstained and one voted yes,” said Multi Board Task Force Chair Lola Finkelstein.


Burden says they’ve listened to the community’s concerns and changed their plan accordingly, with the mayor’s office guaranteeing money upfront for infrastructure improvements and adding a provision regulating the start of construction among other things.


“The new development will be coupled with subway improvements and improvements to sidewalks and open space,” Burden said.


But opponents say the plan shortchanges those improvements by valuing air rights that would help fund them for hundreds of millions of dollars less than they’re worth. The City Council now has 50 days to approve, deny or modify the plan.


“We still don’t know the precise way that infrastructure investments will be funded up front, we have questions about the level of density, the way that the pricing of the air rights is set up,” said City Councilman Daniel Garodnick.


According to the councilman, a vote on the plan is expected sometime in November.

One by one, the stars stepped to the podium, repeating the championship goal that would justify Mikhail Prokhorov’s massive investment.


This is what you’d expect from Media Day of a team with high-priced veterans, a collection of winners who said all the right things Monday – they’ll lead by example, they’ll sacrifice their shots and stats, they’re removing all egos from a locker room filled with All-Stars.


As unbelievable and hyperbolic as it sounded, there’s reason to believe Paul Pierce and Kevin Garnett. They’ve done it before. Pierce raised the stakes as the last player interviewed Monday, declaring that a division title – which is something the Nets haven’t won since 2006 – is unworthy of celebration.


They don’t hang those banners inside Boston Garden.

“Truthfully, it’s not that important to me. I came here to win a championship,” said Pierce, who won five straight Atlantic titles with the Celtics. “I don’t even want to see an Atlantic banner put up if we win. I don’t even know how many Atlantic divisions we won in Boston. I don’t even know. I don’t remember getting a hat, a t-shirt, a call. It’s the division. You don’t get anything for it.

“The expectations have grown here in Brooklyn. It’s no longer the New Jersey Nets, hoping we can win the division. Now we’re the Brooklyn Nets with championship aspirations.”


It’s is quite the 180-degree turn from years past, especially those final teams in Jersey. Sure, the Nets declared themselves title contenders before last season, but that was quickly exposed as the pipe dream and exaggeration experts predicted.


These new Nets – the three additions from Boston and coach Jason Kidd – already own a ring, so their swagger carries substance. Garnett, who contemplated retirement before agreeing to join the Nets, opened his media interview with a statement resembling title-or-bust.

“We’re here to get another ring,” he said. “That’s the only reason we came to Brooklyn –the only reason we came to Brooklyn.”


Still, there was an understanding the team will have to lean on Deron Williams.

“He’s an MVP candidate off the top,” Jason Terry said. “When you have a roster like we have and you give him the ball it’s pretty much his job to go out and lead. And he should be able to do that. He should be able to go out freely and play his game. There are no restrictions on him, whatsoever. We’re going to follow his lead.”


The Nets and Knicks have an opportunity to capture the city’s attention for the winter, especially with the failures of the area’s football teams. But there was a greater realization Monday that this’ll require winning beyond New York, as Brooklyn players downplayed the predictable questions about “Honey Nut Cheerios” and besting the Knicks.

“Have not,” said Garnett when asked if he’s spoken to Carmelo Anthony. And that was that.


There’s an excitement in the unknown in Brooklyn, a tangible buzz that stands on its own, without the Knicks as the backdrop. According to team’s public relations department, they credentialed 150 members of the media for Monday, a 50 percent increase from last season – and about a 500 percent increase from the final media day in New Jersey.


“All the markets are small compared to New York,” Garnett joked from the podium.


So are the expectations.

Judge testifies against court stalker who posed as intern


A Brooklyn judge found herself on the other side of the bench Monday, taking the witness stand against a creepy stalker who was so obsessed with the court system he lied his way into a judicial internship — and then developed a disturbing fixation on the jurist.


Christopher Ransom, 22, is on trial for violating restraining orders filed on behalf of two female judges when he tried to sneak back into Brooklyn Supreme Court.

“He would come into my courtroom on various occasions and try to get the attention of the court officers,” testified Justice Patricia DiMango.


“I said, ‘Maybe I can help you get an internship with another judge,’ and he said, ‘No, I want to do an internship with you.”


DiMango eventually relented and gave Ransom an internship that allowed him to observe her one morning a week.


He pleaded guilty earlier this year to lying that he was enrolled in college to snag the internship and then weaseling his way into restricted areas of the courthouse — like the judge’s chambers.


Ransom asked multiple times for a court pass that would give him greater access to the courthouse, DiMango testified.


“He was obsessed with the idea of getting into the courthouse without passing the magnetometers,” said DiMango, adding that Ransom once startled her by appearing outside her chambers in a dark overcoat.


Ransom previously pleaded guilty to two 2010 crimes: shoplifting 78 USB drives worth $ 1,300 from Target in Brooklyn and for telling a gal pal he was a cop and then sleeping over and stealing $ 1,500 from her.

City Education officials are boosting STEM — science, technology, engineering and math — by offering more than 120 new advanced placement courses in related subjects at 55 high schools starting next year.


The expansion will provide about 2,500 students with new access to advanced classes in biology, calculus and environmental science. Other advanced courses, including English literature and world history, will be offered as well.

To fight the achievement gap faced by black and Hispanic students in the city’s public schools, the majority of the new resources will be aimed at those student groups.


“The AP expansion program will prepare our students to compete and succeed in new and emerging fields of study and careers,” Schools Chancellor Dennis Walcott said.

Body of Suspect in Long Island Shootings Is Found


A recreational boater came across the body of Sang Ho Kim, 63, around 8:30 a.m. near Iona Island, a marshy landmass just south of the Bear Mountain Bridge.


Mr. Kim’s widow said Monday evening in a telephone interview that his body was found near where his mother’s ashes were scattered several years ago.Mr. Kim’s white Honda Pilot was found abandoned on Wednesday evening about eight miles away, near Cold Spring. That morning, the police say, he walked into Savenergy, a company in East Garden City, and shot his former boss, John Choi, and a store employee, Yong Jae Shin, in a dispute over money he believed he was owed. Mr. Shin died.


“The tragic violence in East Garden City and the search for Mr. Kim in our local community caused fear and apprehension for many folks,” the Putnam sheriff, Donald B. Smith, said in a statement. “Today’s events have at least allowed us to turn the page on what was a scary chapter for local residents.”


A manhunt led to lockdowns at several schools across the county, north of New York City, and involved over 100 law enforcement agents, some of whom were dropped from helicopters to search mountainous terrain.


Mr. Choi, the owner of the energy company, was in critical but stable condition on Monday, according to his family. A wake for Mr. Shin was held on Sunday in Flushing, Queens.

Bikers Chase, Assault Driver After West Side Highway Collision


A group of bikers who allegedly chased down and assaulted a man in Manhattan over the weekend were all caught on tape.


Police say it all started when the driver of an SUV collided with one of the motorcycles Sunday afternoon on the West Side Highway.


They say he was concerned over his safety since he had his wife and child in the vehicle with him, so he left the scene.


The group later caught up with the SUV in Washington Heights, and began smashing windows and mirrors.


The driver of the SUV was then assaulted.


He was treated at Columbia Presbyterian and released.


His family was not hurt.


An investigation is ongoing.

Ban on toy lighters shaped like guns






ALBANY — Those novelty lighters that look like guns, cars, toys, and cartoon animals are being snuffed out in New York.


Gov. Andrew Cuomo has signed a bill into law that prohibits the sale of the items often displayed near cash registers at convenience stores, hardware stores and other retailers. The lighters range from small toy-like bodies with whistles and buzzers to larger M-16 military rifle replicas.


Assemblyman Jeffrey Dinowitz of the Bronx says the aim is to keep children who come across the lighters at home from playing with them and creating a fire hazard. Dinowitz sponsored the bill.


New York joins at least 14 states including Massachusetts, New Jersey and Illinois that have banned novelty lighters.


The U.S. Fire Administration supports the bans.

One minute he was enjoying the music, the next he was flattened by a falling concertgoer.


In papers filed in Manhattan Supreme Court, Yosef Allen, 24, says he suffered “severe and permanent personal injuries” at a Justice show at the Hammerstein Ballroom when a fellow fan fell off the second balcony and landed on him on the ground.


The unidentified fan was apparently fine – witnesses said he was smiling and flashing metal fingers after the fall – but Allen was “horribly injured” with back, neck, and head injuries, said his lawyer, Glenn Faegenburg.


“He absorbed the impact,” Faegenburg said of the freak Oct. 21, 2012, accident.


Allen initially wasn’t planning on seeing the Grammy-nominated French electronic music duo, but went after a pal’s girlfriend backed out at the last minute, leaving him with an extra ticket, Faegenburg said.


Allen, who’d been working as a customer service rep at B + H Camera, suffered multiple fractures in his spine and extensive ligament damage in his knee that required two reconstructive surgeries, the lawyer said.


In total, he missed almost six months of work – and his mind doesn’t feel as sharp as it used to, Faegenburg said. “The speed with which he can call up words has been affected,” the lawyer said.


The concertgoer, who’d fallen approximately 30 feet, left under his own power, the lawyer said.


The suit charges the popular midtown venue with “permitting concertgoers to be unruly; in permitting excessive amounts of alcohol” and “failing to furnish proper guardrails on the upper levels and balconies” and seeks unspecified money damages.


The falling fan, who has not yet been identified, is also a target of the suit. He’s named as “John Doe.”


A rep for Hammerstein did not immediately return a call for comment.

Possible body of LI office shooter found


Police are investigating whether the body of a man pulled from the Hudson River on Monday morning is that of a disgruntled worker, who disappeared after shooting two men at a Nassau County office — killing one.


Cops found Sang Ho Kim’s white Honda Pilot hours later on Wednesday, near Sandy Beach in Putnam County. The beach is across the river from Bear Mountain in Rockland County, where the body was found around 9:30 a.m., Monday, cops said.


The New York State Police in Monroe and the New York State Park Police fished the body out of the river near Iona Island and the Bear Mountain Bridge, the agencies announced.


“The body appears to have been in the water for several days,” troopers said in a news statement.


Troop F Forensic investigators and the Rockland County Medical Examiners Office are working with the Nassau County Police to identify the body, the State Police announced in a statment.

Fallen celebrity lawyer busted for choking girlfriend: Prosecutors

Fallen celebrity lawyer Dominic Barbara was arrested late Sunday night for choking his girlfriend, authorities said.


Barbara, whose clients have included the likes of “Long Island Lolita” lover Joey Buttafuoco, was charged with criminal obstruction of breathing for the attack, which authorities said happened on Aug 23.


According to a criminal complaint filed by the Nassau County District Attorney’s office, Barbara, 57, got into an argument with the woman at his Williston Park home before it became physical.


Barbara “put his hands around the victim’s neck and applied pressure, causing the victim’s breathing to become completely obstructed and the victim to be in fear for her life,” the complaint said.


It’s unclear why the unidentified victim waited so long to file a complaint.

Barbara represented himself at his arraignment on Monday morning, and pleaded not guilty. He was released without bail, and ordered to return back to court on Oct. 7.


He faces up to a year in jail if convicted in the choking case — but he has other legal problems on the horizon as well.


Barbara, who in his heyday drove a Bentley, wore $ 1,000 suits and was a regular on Howard Stern’s radio show, is currently awaiting trial on charges he tried to blackmail his wife for $ 200,000.


Prosecutors said he’d vowed to release pictures and videos of her with other men unless she paid up.


He was also busted earlier this year for swiping a $ 1,400 Yves Saint Laurent purse from a Long Island store. That case is also pending.

Federal Gov’t On The Brink Of Shutdown


The Senate is set to reconvene this afternoon just hours before the midnight deadline for a shutdown of much of the federal government, though Senators are expected to reject the House’s latest funding bill.


The Republican majority passed the measure Sunday morning.


It proposes to keep the government going but only if Congress agrees to delay the Affordable Care Act for one year, and get rid of a tax on medical devices that helps pay for the law.


Much of the new health care law is set to take effect Tuesday, including the opening of insurance exchanges.


Senate Democrats and President Barack Obama have repeatedly said the House bill is a non-starter.


Senators on both sides of the aisle are digging in their heels over the measure.


“You want to debate Obamacare, that’s fine. People have strongly held views on both sides. But to hold hostage Democrats and mainstream Republicans until you get your way and hurt millions of innocent people across America along the way is wrong,” said Senator Charles Schumer.


“Even now what the House of Representatives has done is a step removed from defunding. It’s delaying it. Now that’s the essence of a compromise. For all of us that want to see it repealed, simply delaying it on for American families on the same terms as being done for big corporations. That’s a compromise,” said Senator Ted Cruz on NBC’s “Meet the Press” Sunday.


If the government shuts down, about 800,000 federal workers would be forced off the job without pay, starting with the military.


Nearly a million and a half active duty personnel would have their paychecks delayed, including those serving overseas.


Close to 400,000 civilian contractors would be furloughed immediately.


Veterans Affairs services would stay open.


Air traffic controllers would remain on the job.


The TSA and the Department of Homeland Security would remain open.


The State Department would continue to process visa and passport applications, and immigration services would continue to handle green card applications.


Federal courts would continue normal operations for 10 days. After that, they would start to furlough non-essential staff.


The Justice Department would keep prosecuting criminal cases.


Social Security and Medicare checks would still go out as would unemployment checks.


Food stamps and school breakfast and lunch would be unaffected.


The Food and Drug Administration would suspend routine safety inspections, except for the highest-risk cases.


The Centers for Disease Control would have to drastically scale back their ability to investigate outbreaks, including the flu virus.


All national parks would close, including the Statue of Liberty and Ellis Island.


The U.S. Postal Service would continue day to day mail delivery.

Accusations fly over Mondrian SoHo Hotel


One of the world’s most respected boutique hotel groups is locked in a messy court battle with the owners of the celeb favorite Mondrian SoHo, with both sides making bombshell allegations.


Sochin Downtown Realty owns the property, which is run by Morgans Hotel Group. In papers filed in Manhattan Supreme Court and obtained by Confidenti@l, Sochin says, “Morgans’ management of the Hotel was an abject disaster” that cost Sochin large sums.


The documents include allegations from Morgans that Sochin, which was in charge of construction, tried to reduce costs by cutting corners and in the process endangered hotel guests.


As an example, Morgans cites the “elimination of all but one generator so that (Morgans) faced exponentially greater difficulties in the wake of Hurricane Sandy.”


The hotel opened to much fanfare in February 2011 following a party thrown by Kanye West where fake money was shot out of cannons. It houses the very popular Mr. H nightclub and Soaked rooftop lounge, as well as the Isola Trattoria restaurant. Some of the stars recently spotted there include Blake Lively, Matt Lauer and Jon Bon Jovi.


Not all the big names have been happy with the hotel’s design, Morgans adds: “In one instance, an A-list celebrity celebrating a birthday at the Hotel with several friends checked out of the Hotel shortly after checking in, citing the inferior penthouse suite size.”


The company also claims that because of Sochin’s conduct, Morgans has missed out on annual incentive fees, causing “substantial financial harm.”


Morgans also says it has funded about $ 1.2 million in pre-opening expenses and operating shortfalls and hasn’t been reimbursed.


Most seriously, Morgans says that “Sochin made false, defamatory statements that impugned (Morgans’) integrity, in the presence of a third-party lender with whom Morgans Hotel Group … maintains an ongoing relationship.”


Returning fire, the owners say “Morgans’ performance caused the Hotel to place last compared to its competitive set of hotels in revenue per available room.” Sochin also says Morgans mismanaged the Mondrian by overbilling, incurring expenses without its approval and failing to hit certain budget and profit targets.


A Delaware Chancery court this month ordered Morgans out of the hotel.


A rep for Morgans said: “We plan to appeal the court’s decision if the order is not vacated. We continue to believe that a negotiated resolution of this dispute … is preferable to litigation. In the interim, Mondrian SoHo continues to operate business as usual under our existing management agreement.”


Joshua D. Bernstein from the law firm Pryor Cashman, representing Sochin, said: “Ownership believes it was forced into this situation by the ongoing poor performance and mismanagement of the hotel by Morgans, and while we are gratified that the Delaware court granted our motion and issued the order that it did, Sochin continues to work to find an amicable resolution with all parties.”

It’s a relationship that has been on the brink of all-out war for almost 43 years. And now legendary guitarist Jeff Beck has fired his latest salvo at one-time friend Rod Stewart.


Beck, 69, insists he will never reunite the Jeff Beck Group, his ’60s band that included Stewart, who’s 68.


“He is all over the place. He has got a full life, half a dozen kids, wives and I don’t want to be a toy thing that he messes with,” Beck told Confidenti@l.

Bikers attack SUV after driver rams riders


A terrified SUV driver surrounded by a gang of motorcyclists on the West Side Highway Sunday gunned the engine and ran over several bikes before speeding off with the pack in hot pursuit, police sources said Monday.


The harrowing chase, which ended with the enraged bikers smashing the SUV driver’s side window open and slashing him on West 178th Street in Washington Heights, was captured by a camera apparently attached to a biker’s helmet, producing a 6-plus minute video that quickly went viral on YouTube and elsewhere.


The driver – an unidentified man in his 30s whose wife and child were also in the vehicle – was rushed to Columbia Presbyterian Hospital for stitches after the attack, police sources said.


It was unclear what started the dispute, but in the video, several dozen speeding bikers surround a dark-colored Range Rover with New York plates heading northbound on the highway in northern Manhattan, with one motorcyclist purposely slowing down in front of the SUV and forcing it to stop about 2 p.m.


Others quickly park in front of it as one biker dismounts and starts walking threateningly toward the vehicle.


At that point the driver guns the engine and crashes over several bikes and speeds off in a desperate bid to escape.


The bikers pursue the man through northern Manhattan and block him again as he gets caught behind another vehicle, with one biker yanking open his door.


But the driver guns it again and manages to get away after knocking another bike to the ground.


The SUV then speeds off the West 178th Street ramp into Washington Heights with the bikers swarming behind him, blowing through at least one red light at his speed.


Finally, traffic forces the SUV to stop on West 178th between Wadsworth and St. Nicholas avenues.


One rider then rips off his helmet and uses it to bash in the driver’s side window as the video ends.


The crew then slashed the man in front of his wife and child, police sources said.


No arrests have been made and police are investigating the assault.


At least one of the riders’ jacket patches indicate he’s a member of a New Rochelle motorcycle club.

Washington Beat: House Spending Vote Has Local Reps Split As Gov’t Shutdown Looms


The House capped off a wild week late Saturday and approved a spending plan that would delay the implementation of the Affordable Care Act, setting the stage for a possible government shutdown beginning October 1. NY1 Washington Bureau reporter Michael Scotto filed the following report.


The anger in Washington is palpable these days. On the floor of the House, screaming erupted as Congressman Eliot Engel accused Republicans of wanting to shut down the government.


“You can yell all you want, but you’re not silencing the voice,” Engel said.


In the end, the House approved a government spending plan that would delay Obamacare for a year and scrap a tax that helps fund the law.


New York Congressmen Chris Gibson and Richard Hanna were the only two Republicans to oppose the delay.


The vote happened one day after the Senate passed a funding plan that would keep the Affordable Care Act intact.


“Right now the media wants to paint it as Republicans are completely unreasonable, and there are some that are, I agree with that. But to say if we don’t acquiesce to everything Democrats want, we’re the unreasonable ones. I don’t buy that,” said Rep. Michael Grimm.


The move means the government will almost certainly shut down next week, for the first time in nearly 20 years.


Senate Majority Leader Harry Reid called the Republican vote pointless and the White House promised a veto if it came to the president.


“They know it’s not going to be accepted and they really, in a sense, are calling for a shutdown,” said Rep. Charles Rangel.


Democrats did go along with a Republican measure that would pay military members during a government shutdown.


“Obviously we need to keep paying our men and women in uniform, but that really misses the point that we really shouldn’t be shutting down the government period,” said Rep. Sean Patrick Maloney.


The vote underscores the power of the tea party caucus, which all but forced House Speaker John Boehner to take this route, even though he knew Democrats would never go along with it.


Even Republicans who supported the bill fear it emboldens the far right of their party.


“If this part of a process fine, I’ll vote for it. If we do, we just allow people to hijack our party and the government,” said Rep. Peter King.


The Senate is not scheduled to return until Monday, when it will likely reject the House’s plan.

Tax crackdown yields city $72M


The city is rolling in dough, thanks in part to a recent crackdown on tax cheats.


The Department of Finance has saved $ 72.8 million over the past two years by tightening the reins on generous but often erroneous property- tax exemptions, according to data obtained by The Post.


The biggest windfall came from nonprofits, which have been the focus of a department crackdown in recent years.


The agency reported saving nearly $ 31 million between Fiscal Year 2012 and the current fiscal year, 2014, by registering 1,000 fewer nonprofits for the tax breaks, the data show.


In the current fiscal year, 15,053 such charities were registered with the city, down from 16,057 in FY 2012 and 15,188 in FY 2013.

That resulted in a $ 10.7 million savings to the city last fiscal year with another expected $ 19.9 million savings this year, the statistics show.


Two years ago, the department began double-checking entities claiming nonprofit status to avoid property taxes and found many that had no longer been registered as tax-exempt charities — but continued to get the perk.


In addition, the department has saved cash by instituting far more stringent measures on personal property-tax exemptions, such as those for seniors, veterans and disabled homeowners.


The Post disclosed in 2011 that the agency was giving away the freebies without verifying a homeowner’s status.


Since then the department has required military discharge papers for veterans and a Social Security disability form from anyone applying for that exemption.


Some 47,255 homeowners are collecting the senior-citizen exemption this year, down from 52,104 two years ago, the data show.


That translates into a savings of $ 13.3 million.


The exemptions vary in amount, depending on the taxes paid.


“We have a duty to protect those who do the right thing,” said Finance Commissioner David Frankel. “Our goal is to make sure that exemptions are going to New Yorkers who qualify, and not to those who do not.”


The veterans’ exemption is also on the decline — from 64,024 recipients in FY 2012 to 53,545 in FY 2013 and 52,969 in FY 2014.


But a department official speculated the reduction is due in part to older veterans dying. Only the number of disabled homeowners collecting a tax exemption is on the rise, from 4,896 in FY 2012 to 5,227 in FY 2014. That’s an increase of about $ 1 million in exemptions over the past two years.

Poll Finds Support for New Casinos in State


Opinions about the general idea of expanded gambling were divided, but when the pollsters asked voters the actual question that would appear on the Nov. 5 statewide ballot, 55 percent said they would support it, 42 percent said they would oppose it and 3 percent were undecided. The ballot language presents only positive arguments for gambling, saying that allowing more casinos would be for the purposes “of promoting job growth, increasing aid to schools and permitting local governments to lower property taxes.”


The poll suggested that the wording of the question is significant. When voters were asked the question in a different way, without a list of casino development’s intended purposes, they were evenly divided.


The poll, conducted from Sept. 22 to 26, queried registered voters statewide, making its predictive value uncertain. There are no statewide elections this year, and turnout is expected to be generally low and widely varied, depending on the competitiveness of local races. In New York City, where turnout could be higher because there is a contested race for mayor, voters appear to be more skeptical of the casino referendum.


The poll found that voters agree with arguments both in favor of and against expanding casino gambling.


Seventy-four percent agreed that allowing the development of casinos would create thousands of jobs, and 65 percent agreed that more casinos would generate significant new revenue for the state and for local governments.


At the same time, 57 percent agreed that the state already has enough outlets for gambling and did not need more casinos. And 55 percent agreed that developing casinos would only increase societal problems, like crime and compulsive gambling.


So far, the debate over the referendum has been muted, with supporters of the casino proposal keeping a low profile. No well-funded opponents have emerged, although on Sunday, the New York State Catholic Conference warned of social problems associated with gambling.


Government watchdog groups have raised concerns about the wording of the ballot question, which the State Board of Elections approved after consultation with Mr. Cuomo’s office. But in the poll, 51 percent of voters said they thought the question was fair; 43 percent deemed it unfair.


The poll suggested that opponents of the casino referendum feel more strongly about the issue than voters who supported the proposal. Sixty-eight percent of opponents said they would be upset if the measure passed, compared with only 40 percent of supporters who said they would be upset if the referendum failed.


Another referendum that will be on the November ballot, one to amend the Constitution to allow some judges, including those on the state’s highest court, to serve until they are 80 years old, appears to be in trouble. Seventy-one percent of voters said they would vote against the proposal, compared with 26 percent who said they supported it.


The poll, conducted by telephone with 807 registered voters, has a margin of sampling error of plus or minus three percentage points.

Jorge Alvarez, 44, was shot in both legs when he was caught in the crossfire between two drug gangs on Aug. 13, one day after Manhattan federal Judge Shira Scheindlin ruled the NYPD’s use of stop-and-frisk unconstitutional.


Alvarez said he was walking home in Harlem with his wife after an evening of shopping when a hail of gunfire exploded. He tried to run as the bullets started flying but couldn’t move fast enough.


Cops later told him at least three weapons were fired during the barrage of shots, he said.


He was among the 164 New Yorkers struck by bullets during the 28-day period that ended Sept. 8, marking a 9-plus percent increase over the same period in 2012. Shooting incidents also spiked nearly 13 percent, to 140, with police sources noting that “perps are not afraid to carry a gun” due to the reforms Scheindlin has ordered.


“They have to get illegal guns off the street. The only way to do that, besides stopping the sale of guns, is stop-and-frisk,” Alvarez said through a Spanish interpreter.

More than a month after the shooting, Alvarez still suffers pain in both knees and has no feeling in his right thigh. He’s also been unable to return to his job at a New Jersey liquor store.


A more tragic supporter of stop- and-frisk is grieving Brooklyn mom Tonia Garcia, whose son, Dominique, 22, was killed during a traffic dispute in their East New York neighborhood early Aug. 18.


According to cops, Dominique was in the passenger seat of a car whose driver honked at a group of men blocking an intersection.


A heated dispute erupted, during which one of the men pulled out a pistol and shot Dominique in the head. He was rushed to Brookdale Hospital, where he died.


“Nobody will ever understand what I’ve been through,” his mom lamented. “Stop-and-frisk is the best policy — it caught more criminals. Now, everyone is running rampant.”


Asked what she would say to Scheindlin if given the chance, Garcia said, “Come live in it for a little while, move in the neighborhood for a little while.


“Somebody gets killed over here once a week, twice a week,” she said, adding, “Stop-and-frisk keeps people safer.


“I don’t think they should stop it The amount of crimes being committed would be way less on the streets.”

Shut and open case


School closures — the great bugaboo of the United Federation of Teachers and New York’s Democratic political establishment — have been a historic benefit to tens of thousands of the city’s high school students. The city must continue to shutter failure factories.


As Gov. Cuomo said last month, “There is going to have to be a death penalty for failing schools.”


The wisdom of putting the worst schools out of their misery leaps from the pages of a study into the results of the Bloomberg administration’s most aggressive program of starting schools from scratch — with new administration, staff and curriculum designed in collaboration with experts and community leaders.


In 2002, the Department of Education targeted 31 large failing high schools. All of them bore familiar names, deep ties as local institutions and records of horrendous performance. Chancellor Dennis Walcott recalled the nightmares that these places were in a recent speech whose facts seem impossible to comprehend a little more than a decade later.


Here are a few of the long-accepted graduation rates: Morris High School in the Bronx, 31%; Erasmus Hall High School in Brooklyn, 32%; Samuel J. Tilden High School in Brooklyn, 43%. All were beset by disorder and violence.


“At Adlai Stevenson High School in the Bronx, gang fights in the late 1990s were so common that teachers regularly pulled down iron gates from the hallway ceilings to contain rioting,” Walcott recalled.


With student bodies running into the thousands — and entrenched personnel — the 31 worst high schools defied reform. Over a period of several years, the department shut them down and opened more than 200 much smaller schools, all founded by organizations that competed for the right to run them, designed them with community input, won administrative flexibility and formed relationships with the United Federation of Teachers.


MDRC, an education research group, has now determined the outcome. Researchers compared the high school careers of students who applied to the 200 schools and were admitted with the careers of students who applied and wound up at a broad range of other schools.


While high school graduation rates rose generally, they rose highest for those in the new small schools. The four-year graduation rate climbed to an average of 70.4% — almost 10 percentage points higher than high schools at large. More of their graduates won Regents diplomas than in other schools, and more of their graduates scored at least 75 on the English Regents, the level deemed necessary to succeed in college.


Despite such demonstrated success, Democratic mayoral candidate Bill de Blasio is among those who call for a moratorium on school closures. He argues that the Bloomberg administration moved too far, too fast in moving on a wider range of closings. Whatever incidental anecdotes he may cite to support his point, to halt closures is to halt one of the most effective tools of raising student achievement. The idea serves only the interests of the UFT, now in de Blasio’s corner.
