Teen who allegedly started fire that killed Brooklyn cop slapped with murder charges

The teenage firebug who allegedly started a blaze that killed a hero cop was slapped with murder charges Friday — as a relative of fallen officer broke down on a hospital visit to the critically injured officer who survived the fire.


Marcell Dockery, 16, was hit with second-degree murder charges and faces 25 years to life in prison after a grand jury came back with the indictment.


Officer Dennis Guerra died on Wednesday, days after her was overcome with smoke after he and Officer Rosa Rodriguez ran into a Coney Island housing project on the 12th floor.


Guerra and Rodriguez were the first to respond and were quickly overcome by the smoke.


One of Guerra’s relatives broke down on a hospital visit Friday to Rodriguez.


“This shouldn’t have happened,” an uncle of Guerra cried out in the burn unit waiting room at New York-Presbyterian Hospital Weill Cornell, where Officer Rosa Rodriguez, 36, has been steadily improving in health.

“They shouldn’t have to go into somewhere it isn’t safe! They don’t have the equipment! My nephew is dead!”


As he sobbed and his voice became horse from screaming, an adult daughter rushed to embrace him.


“Dad! Dad, stop! Please! Please! Dennis wouldn’t have wanted this! Dennis wouldn’t have wanted this!” she yelled as she tried to contain him.


But her distraught dad lunged at a police officer trying to subdue him as he continued to sob, “My nephew.”


He was quickly ushered away into another room.

His hyperventilating daughter was given a wheelchair as she cried, “My chest, my chest. I’m so upset.”


Dockery allegedly told cops he set a mattress on fire Sunday on the 12th floor of the Coney Island Houses because he was “bored.”


Dockery was initially charged with assault, arson and reckless endangerment after the blaze critically injured the two cops, who were the first to respond to the the fire.


Guerra, 38, a married father of four, died Wednesday from the toxic smoke he inhaled.


He was the first NYPD officer to die in the line of duty since the Dec. 12, 2011, shooting of Officer Peter Figoski, also in Brooklyn.
