The city is being sued by the family of a Rikers Island inmate who died in an overheated cell.
The family of Jerome Murdough filed the notice of claim Friday, citing negligence, violation of civil rights, use of excessive force and wrongful death.
The city of New York, the comptroller’s office and the Department of Correction have been named as respondents.
The family is also asking the city to preserve any evidence related his death.
“He was the light of the family,” said lawyer Tracey Brown. “He was Mr. Friendly. He made friends wherever he went, and to lose him has been really devastating for the Murdough family.”
In February, Murdough’s body was found in the cell with an internal temperature of 103 degrees.
Documents showed that work orders for excessive heat in the cell weren’t acted upon for four days because of the President’s Day holiday.
A Department of Law spokesperson said they will review the suit.
