The parents of a Westchester teen are going nuts over the fact that their teenage daughter was almost killed when a clueless confectionery served her a dessert made with Nutella spread — despite being warned she was highly allergic.
Robert and Lauren Eicher filed a $ 400,000 suit against the celeb-favorite Sugar Factory American Brasserie on Wednesday over the incident, which sent 16-year-old Emily Eicher into anaphylactic shock when she scarfed down the hazelnut treat.
“This is a case about the gross negligence of the wait staff at a popular urban restaurant, gross negligence that nearly cost the life of the plaintiffs’ daughter,” the outraged parents claim in their Manhattan civil suit.
Court papers say Emily made a reservation at the Sugar Factory — a favorite of Kim Kardashian and Britney Spears — on Aug. 14, 2013, and at the time informed the hostess that she had a severe nut allergy.
When she arrived at the Gansevoort Street sweet shop with several friends, the hostess told Emily to warn her server about her condition.
A waitress assured Emily that the group’s order would have no nut products, so they dug into their food, including what was supposed to be a S’mores crepe.
“As Emily ate the food, she began to feel a familiar sensation in her throat, a sensation associated with anaphylactic shock,” the Manhattan Supreme Court filing says.
“She became alarmed and called the waitress over . . . The waitress pointed at the crepe and [said] that it was not a S’mores crepe but a Nutella crepe.”
One of her friends called 911, but Emily’s throat kept constricting so she injected herself in the thigh with an emergency EpiPen, and was then rushed to a hospital.
The Eichers’ lawyer speculated that a busboy must have mixed up the order.
“They brought her a product that’s literally made from hazelnuts,” attorney Emilio Rodriguez said.
A Sugar Factory rep wouldn’t comment.
