Congressman Michael Grimm’s federal tax fraud trial in Brooklyn is being pushed back two months, but the congressman may now face a second trial in Manhattan.
The trial was set to start December 1, but at a court appearance, a judge agreed to delay the start until February.
Grimm’s lawyers asked for more time to review hours of taped conversations made by a potential witness for the prosecution.
The congressman is not on the tapes.
Grimm’s team is also trying to get rid of three of the 20 charges against him because the alleged crimes occurred in Manhattan—outside the district where the case is being tried.
If that happens, prosecutors say they would bring a second trial in Manhattan—something Grimm’s attorney is trying to prevent from happening.
The Republican Congressman is in a tough re-election battle with former Democratic City Councilman Domenic Recchia.
