As police investigate sex assault accusations against high profile attorney Sanford Rubenstein, his role in one of the city’s biggest cases may be in jeopardy.
Rubenstein is representing the family of Eric Garner, the Staten Island man who died after police put him in a chokehold.
The family is expected to file a wrongful death suit against the city.
Reverend Al Sharpton is set to meet with Garner’s family today to determine their next step forward.
This comes as NYPD detectives and crime scene investigators gathered evidence from Rubenstein’s Upper East Side apartment over the weekend.
Sources tell NY1 that’s where Rubenstein and his accuser — a high ranking member of the Nation Action Network — went after Sharpton’s birthday party Wednesday.
They say the woman had something to drink, felt dizzy and passed out.
The next morning, she claims she woke up and saw condoms on the floor.
Sources tell NY1 the woman said she was not alert and didn’t know she was having sex.
According to published reports a source close to Rubenstein says the accuser had consensual sex with him the next morning.
Both Sharpton and Rubenstein’s lawyer addressed the media on Sunday.
“We do not believe a crime was committed and we are hopeful and confident that at the end of the investigation no charges will be filed,” said Rubenstein’s attorney, Benjamin Brafman.
“I feel that I am in a situation that I could not say anything disparaging about either one of them so I’d have to wait and see where the investigation goes,” Sharpton said.
Sources say Rubenstein’s accuser went to the hospital on Friday and that’s when authorities were called.
Sharpton says he will move forward with the Garner case regardless of what happens to Rubenstein.
