Eric Garner’s family has filed the first paperwork necessary to bring a $ 75 million lawsuit against the city.
The city and the NYPD are both named in the filing.
So are six individual officers involved in the arrest that led to Garner’s death in July. Officer Daniel Pantaleo put the 43-year-old in a chokehold while arresting him for allegedly selling loose cigarettes.
The claim cites wrongful death, assault, battery and more than 10 other complaints.
The notice of claim was filed with the Comptroller’s office, which says it’s under review.
The legal action comes as the family’s lawyer, Sanford Rubenstein, finds himself under investigation for sexual assault.
He’s still listed as the family’s representative, but that could change.
Reverend Al Sharpton says the family will announce how it plans to proceed at his National Action Network Rally on Saturday.
