The puppeteer who voiced Elmo for “Sesame Street” has been cleared for a second time of lawsuits brought by three men who said he had sex with them when they were underage boys.
The U.S. 2nd Circuit Court of Appeals dismissed the charges against Kevin Clash, agreeing with a Manhattan Federal Court judge who thew out the suits last year because they were filed after the six-year statute of limitations.
The plaintiffs — Kevin Kiadii, Cecil Singleton and a man referred to in filings as S.M. — had appealed the lower court ruling.
Clash, 53, was the man behind the cuddly kids character for decades but resigned in 2012 after 23-year-old Sheldon Stephens said he was just 16-years-old when he began a sexual relationship with Clash.
The claim prompted additional men to lodge sensational allegations against the puppeteer.
The case brought by Stephens is still pending. Jeffrey Herman, lawyer for the men, is also representing Michael Egan, the actor suing “X-Men” director Bryan Singer for allegedly sexually abusing him when he was 15 at “notorious parties” in Los Angeles and Hawaii.
Herman and a lawyer for Clash didn’t immediately return requests for comment Thursday.
The 2nd Circuit tossed the three suits earlier this month.
