A former Brooklyn prosecutor claims she was “directed” by then-District Attorney Charles Hynes’ legal counsel to sign a sworn affidavit that contained false and misleading information, according to court papers.
In a letter to a federal judge, Barbara Burke claims she was following the orders of top deputy Dino Amoroso when she submitted the original affidavit last summer in connection with the $ 150 million wrongful conviction lawsuit brought by Jabbar Collins.
In the original papers, Burke swore in an affidavit that she was conducting research on the court decision in connection to the Collins lawsuit but she did not know how it would be used.
Now Burke is claiming she was informed by Amoroso that her research on 229 prosecutors the DA’s office claimed were disciplined would be used to prepare Hynes for his deposition in the Collins suit, according to a filing in Brooklyn Federal Court.
Collins served 16 years in prison for the murder of a Brooklyn rabbi before his conviction was thrown out by a federal judge because of allegations of prosecutorial misconduct.
