The city plans to file a motion next week asking a federal appeals court to immediately reverse a judge’s rulings on stop-and-frisk.
The city wants the court to drop the entire case, from the ruling itself to the recommendations.
Judge Shira Scheindlin ruled in August that stop-and-frisk is unconstitutional and also ordered the appointment of an independent monitor to oversee changes, but she was removed from the case last week, with a panel of judges saying she appeared to show bias and had talked to the media about the case.
A law department spokesman said that they are filing the motion because of Scheindlin’s removal.
Scheindlin’s lawyers, meanwhile, have filed an appeal of that decision.
The legal wrangling may end either way come January, however, as Mayor-elect Bill de Blasio has said that he’ll drop the appeal once he takes office.
