Queens State Sen. Malcolm Smith as he entered White Plains Federal Court in April on bribery charges
Prosecutors in the Malcolm Smith bribery case are seeking to keep confidential “covert recordings, wiretap intercepts” and other materials because the investigation that busted the Queens state senator and other political figures in April is ongoing.
White Plains Federal Court Judge Kenneth Karas said Monday he wants to see the evidence next week so he can decide whether it needs to be kept secret, according to Grant Lally, lawyer for Vincent Tabone, a Republican party official charged in the case.
Smith, a Democrat, allegedly tried to grease the wheels so he could run for mayor as a Republican.
