City wins court battle with Expedia over tax

The state’s highest court said that the city had the authority in 2009 to apply the hotel room occupancy tax to Expedia and other online travel companies.




ALBANY— The city won a victory Thursday in a battle with Expedia and other online travel companies over the hotel room occupancy tax.


The Court of Appeals, the state’s highest court, said the city had the authority in 2009 to apply the 6% tax to fees charged by online travel sites for city hotel rooms. The travel sites had argued state law at the time did not authorize such steps.

A year after the case began, the state Legislature passed a measure granting the city explicit authority to tax hotel remarketers — a move that limits the impact of the court battle to one year’s worth of tax revenue, about $ 8 million.
