Two New Yorkers plan to sue the city for injuries caused by tripping over Citi Bike docking stations, court documents show.
In the first-ever Citi Bike-injury related legal action, both pedestrians claim the docking stations caused them to fall last spring, according to notices of claim filings.
Legally blind Chelsea resident Howard Orlick, 52, claims in his notice that he tripped over a Citi Bike station on University Place near 13th Street on May 5 because the base of the gray-colored station blends into the sidewalk, the court papers state.
He suffered an ankle injury and is now seeking $ 500 to cover the cost of his medical bills, which include an X-ray, court documents show.
“May I suggest you paint the bike-rack base a different color, like black?” Orlick notes in the court papers.
“I fell into a six-inch gap and twisted my ankle pretty badly,” he notes.
Lachonne Shelton, 50, claims she injured her elbow, knees and back after she tripped over a Citi Bike station at Centre and Worth streets before the program had officially started on April 24.
The claims says that the city failed to “properly install the sidewalk/bicycle rack, in causing and/or allowing a dangerous condition to exist.”
She plans to sue the city for $ 1 million, court documents show.
