The family of Eric Garner on Saturday commemorated what would have been his 44th birthday by joining the Reverend Al Sharpton at his National Action Network rally.
Garner would have turned 44 on Monday.
After the rally the family was expected to join community members on Staten Island at the spot where Garner died as police tried to arrest him in July.
The medical examiner determined Garner died when police put him in an alleged chokehold which is not illegal, but is against NYPD guidelines.
