Former NYPD Officer Brenderline Blake is suing the city because the Mace she was trying to use to subdue a suspect didn’t work.
A Mace canister that malfunctioned ended a Brooklyn cop’s career, she claimed in a lawsuit.
Former NYPD Officer Brenderline Blake, 40, alleged she was trying to arrest a suspect in the Macy Ave. subway station in Williamsburg three years ago, but her pepper-spray failed, allowing the law-breaker to fracture her wrist.
“As a result of the defects in the canister of mace, Plaintiff was unable to repel a criminal suspect and who, as a result thereof, was able to attack the Plaintiff and cause her a serious physical injury,” said the suit, filed Monday in Brooklyn Supreme Court.
Blake, who left the NYPD with three-quarters disability pay, is asking for unspecified damages from the city for the June 26, 2010 incident.
The scuffle took place at 2:25 a.m. on the Queens-bound platform of the J-line, according to court papers. A group of rowdy riders would not disperse and the confrontation escalated, said Blake’s lawyer Joseph Decolator.
After a woman suspect injured the cop, her partner used his mace – which functioned – and the assailant was collared.
“It shows that if her mace had worked, it would have stopped the incident,” Decolator said.
His client still suffers from Reflex Sympathetic Dystrophy, he said, which is characterized by chronic pain.
A spokeswoman for the city Law Department said, “We are awaiting a formal copy of the complaint.”
