A Bronx cop whose beau is in the slammer for a $ 6 million embezzlement scheme — and who is herself accused of keeping some of the ill-gotten gains — is suing the NYPD for allegedly treating her shabbily.
Sgt. Denise Diaz, 41, was hauled in for questioning in November 2010 after her boyfriend, George Castro, was arrested in a fraud against Columbia University. He was later convicted.
Diaz says in a Manhattan federal suit that her fellow officers gave her “the same treatment as the prisoners that are arrested and held against their will at a precinct,” escorting her to the bathroom and guarding the door of the room in which she was held.
Her gun and badge were taken away, and she was put on modified duty. Two years later, that’s still the case, she says in court papers filed last week against the city.
“It’s unheard of. She’s never been charged with a crime,” her lawyer, Ricardo Aguirre, said.
But Diaz, who is seeking unspecified damages in her federal complaint, isn’t in the clear legally.
The city will review Diaz’s allegations, a Law Department spokeswoman said.
In July, the Manhattan District Attorney’s Office filed paperwork to seize $ 130,000 Diaz allegedly received from Castro..’s Internet hacking scheme after Diaz refused to return the funds.
Castro, 50, the father of Diaz’s two children, allegedly used his access to Columbia’s payroll system to help pull off the scheme, redirecting payments from the school to himself rather than the proper vendors. He was sentenced to seven to 21 years in prison on grand-larceny and money-laundering charges.
Aguirre said the forfeiture move by the Manhattan DA is currently in litigation.
